General Provisions

These General Conditions of Sale and Delivery govern purchases from, and use of the www.hoot.ch website and forms a contract between the Customer and: HOOT SA (HOOT Ltd), Rue de Genève 56, 1004 Lausanne, Switzerland, info@hoot.ch.

Please make sure that you have read carefully all conditions of sale and delivery when using our website.

By making a purchase from, and using this website, the Customer have agreed to these General Terms and Conditions of Sale. When placing an order, by checking the box when on hoot.ch, the Customer declares to have read and accepted these terms and all conditions referring to Privacy Policy.

Conditions

Each Customer must be of legal age and have legal capacity to conclude such contracts. In case the Customer is under the age of majority or has no legal capacity, the order must be submitted by a parent or a guardian. All orders made in violation of this provision and all subsequent contract will not be effective.

Account Registration and Confidentiality

When shopping with HOOT Watches, we will save some of your data to fulfill your purchase. All personal information is treated confidentially.

Purchase and Order

Any order on the website is a purchase in accordance with and subject to these terms and conditions.

After submitting the order, payment is handled by a secure authorization and under strict banking standards. Then, we will send, by e-mail, a confirmation of your purchase with the summary of the order and the delivery date. It originates a binding contract of sale.

HOOT SA reserves the right to disclose personal data and secret transactions for fraud control and security purposes.

HOOT SA reserves the right to refuse or cancel orders received at any time, in the event of a dispute about the payment of a previous order.

Prices, Taxes and Customs Formalities

Prices are in Swiss francs, euro or dollars depending on the daily rate. HOOT SA reserves the right to modify sales prices at any time before placing an order.

Shipping costs will be shown separately, and shall be validated during the payment.

All prices shown on HOOT Watches website are including Swiss VAT in accordance with the applicable legislation. In case an order will be dispatched to a delivery address outside Switzerland, please note that you may be subject to additional costs for import taxes, customs charges or customs duties. It should be noted that HOOT has no control if your parcel should be subject to customs authorities’ inspection.

Once the payment is complete, the total price includes:

1) Price of item/s ordered,

2) Swiss VAT whenever applicable

3) Shipping costs.

The total price of your purchase does not include taxes, duties or any other customs fees, collected in the country of destination. Additional costs are at the expense of the Customer.

Items will be dispatched upon receipt of full payment from the Customer. It may affect delivery times indicated on the site. All credit card payments are subject to a validity check by the car issuer which must, in addition, authorize the payment.

Methods of Payment

HOOT SA accepts Paypal, Mastercard, Visa and Amex payments.

Shipment and Delivery Policy

Orders are shipped within 5 to 15 business days upon receipt of full payment from the Customer. Items will be delivered to the address given by the Customer. 

Whenever possible, a group ordering of multiple items to the same address and the same customer will be dispatched together to limit delivery costs.

NOTE: HOOT SA does not deliver in a PO Box neither to minor individuals, without prior written request of the parent or guardian.

HOOT SA declines all responsibility for any failed delivery due to subsequent changes or error of address. Return procedure costs can be charged to the Customer.

Return or Exchange Policy

To proceed to return or exchange, items must be returned in their original packaging (with their reference) and in perfect condition within 14 days of delivery. Return of products must be accompanied by a copy of the invoice. Damaged, soiled or incomplete items or packaging will not be accepted back. Shipping costs are at the expense of the Customer.

Warranty

Every item is covered by two-year warranty. This warranty covers manufacturing defects on the watch itself. 

Responsibility and Ownership

In compliance with the law, HOOT SA bears no legal responsibility as for the use and the website’s (www.hoot.ch) contents as well as for all the links and references in it. HOOT SA does not guarantee nor assume any element found in the website. HOOT SA declines liability for the contents on the website, except for individual and specific confirmation from HOOT SA, such as a purchase confirmation.

HOOT SA holds the exclusive rights of intellectual property over the entire website’s content www.hoot.ch as well as the products, attributes and information presented therein. Any reproduction, use or exploitation not expressly authorized by HOOT SA is prohibited.

HOOT SA intends to comply with legislation applicable regarding data protection. In accordance with applicable legislation and the framework set by these general conditions, HOOT SA commits to respect personal data confidentiality.

Governing Law and Jurisdiction

Subject to mandatory legal provisions to the contrary, these terms and conditions are to be construed in accordance with the laws of Switzerland and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of Lausanne courts, Switzerland.
